Same-Sex Marriage and Religious Liberty: Are they in Conflict?
Mark David Hall, George Fox University
The Supreme Court’s decision in Obergefell v. Hodges, the 2015 case that requires all states to legally recognize same-sex marriages, raises a host of questions regarding religious liberty. Will clergy be required to perform same-sex weddings? May religious colleges refuse to hire candidates who are in same-sex relationships? Is it permissible for business owners to decline to participate in same-sex wedding ceremonies? Dr. Hall will offer a balanced assessment of the threats posed to religious freedom by Obergefell and related laws as well as contend that America’s long history of crafting religious accommodations to neutral, generally applicable laws suggests a way to best protect the rights of all Americans.
